Yeah, there's no way the chance of Counterlight loss is 50/50. There may be a slim chance to keep some (I somehow ended up with a 64% chance of progress), but I think the default is as you say: no loss on the first check, -5 for the rest. The EPA analysis should examined and recalculated.
